Terms of Service

1. Agreement to Terms

By accessing and using Luster Car Rentals services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Rental Requirements

Driver Eligibility

  • Must be at least 21 years old (25 for certain vehicle categories)
  • Hold a valid UK or international driving license for minimum 1 year
  • Provide valid credit card in driver's name
  • Meet all insurance requirements
  • Pass identity and credit checks

Additional Drivers

Additional drivers must meet the same requirements and be present during pickup to be added to the rental agreement. Additional fees may apply.

3. Reservations and Payments

Booking Process

  • Reservations are subject to vehicle availability
  • A valid credit card is required to secure your booking
  • Confirmation does not guarantee specific vehicle model
  • All rates are subject to applicable taxes and fees

Payment Terms

  • Payment is due at time of rental pickup
  • Security deposit will be authorized on your credit card
  • Additional charges may apply for extras, damages, or violations
  • All payments must be made in GBP

4. Vehicle Use and Restrictions

Permitted Use

  • Vehicle must be driven on paved roads only
  • Use within UK and specified European countries only
  • Maximum of authorized drivers only
  • No commercial use without prior agreement
  • Comply with all traffic laws and regulations

Prohibited Activities

  • Racing, rallying, or competitive driving
  • Driving under influence of alcohol or drugs
  • Carrying hazardous materials
  • Smoking in vehicles
  • Pet transportation without prior approval
  • Subletting or unauthorized use by third parties

5. Insurance and Liability

Basic Coverage

All rentals include basic insurance coverage as required by UK law. This includes:

  • Third-party liability insurance
  • Collision damage waiver (with excess)
  • Theft protection (with excess)

Customer Responsibility

You are responsible for:

  • Excess amounts as specified in rental agreement
  • Damage to interior, tires, and undercarriage
  • Loss of keys or vehicle documents
  • Traffic violations and fines
  • Fuel costs and mileage charges if applicable

6. Cancellation and Modification

Customer Cancellations

  • Free cancellation up to 24 hours before pickup
  • Cancellations within 24 hours: 50% of daily rate charged
  • No-show: Full rental charge applies
  • Refunds processed within 7-10 business days

Our Right to Cancel

We reserve the right to cancel reservations due to:

  • Vehicle unavailability due to damage or maintenance
  • Customer not meeting rental requirements
  • Fraudulent or suspicious activity
  • Force majeure events

7. Return Conditions

Vehicle Return

  • Return vehicle at agreed time and location
  • Same fuel level as at pickup
  • Clean interior and exterior condition
  • All keys, documents, and accessories included
  • Late returns subject to additional charges

Inspection and Charges

Vehicle will be inspected upon return. Additional charges may apply for:

  • Damage beyond normal wear and tear
  • Excessive cleaning requirements
  • Missing fuel
  • Lost or damaged items
  • Smoking odors

8. Breakdown and Emergency Procedures

Emergency Contact

In case of breakdown, accident, or emergency:

  • Contact our 24/7 emergency line immediately
  • Do not arrange unauthorized repairs
  • Follow all safety procedures
  • Cooperate with emergency services if required

Roadside Assistance

We provide 24/7 roadside assistance covering:

  • Mechanical breakdowns
  • Flat tire assistance
  • Battery jump-start
  • Lockout service
  • Emergency fuel delivery

9. Data Protection and Privacy

We collect and process your personal data in accordance with our Privacy Policy and UK GDPR requirements. By using our services, you consent to our data processing practices as outlined in our Privacy Policy.

10. Limitation of Liability

Our liability is limited to the maximum extent permitted by law. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of business, profits, or data
  • Personal belongings left in vehicles
  • Delays due to traffic, weather, or mechanical issues
  • Third-party actions or omissions

11. Dispute Resolution

Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of English courts.

Resolution Process

  1. Direct negotiation with our customer service team
  2. Mediation through approved mediation services
  3. Court proceedings as last resort

12. Modifications to Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the revision date. Continued use of our services after changes constitutes acceptance of new terms.
